With each novel infectious disease outbreak, there is scholarly attention to healthcare providers’ obligation to assume personal risk while they care for infected patients. While most agree that healthcare providers have a duty to assume some degree of risk, the extent of this obligation remains uncertain. Furthermore, these analyses rarely examine healthcare institutions’ obligations during these outbreaks. As a result, there is little practical guidance for healthcare institutions that are forced to weigh whether or when to exclude healthcare providers from (...) providing care or allow them to opt out from providing care to protect themselves. This article uses the COVID-19 pandemic to examine the concept of risk and the professional duties of both healthcare providers and healthcare institutions, and proposes a framework that can be used to make concrete institutional policy choices. This framework should be a useful tool for any hospital, clinic, or health agency that must make these choices during the current pandemic and beyond. (shrink)

The Council on Ethical and Judicial Affairs of the American Medical Association examines physicians’ professional ethical responsibility in the event that the security of patients’ electronic records is breached.

Kane provides Self-Forming Actions as a rebuttal to allegations that indeterministic choices are determined by luck and are therefore not free. This paper explicates Kane’s proposal and provides a conceptual complication for Kane’s SFAs. The quantum events in an indeterministic world can be recreated in a deterministic world by pseudorandom number generation. This deterministic world is indistinguishable from the indeterministic world it simulates at the quantum, neurological, and phenomenological levels. Thus, indeterministic quantum behavior cannot secure free will in Kane’s SFAs (...) in any way which is not reproducible in a deterministic world. The paper addresses the objections that the proposed problem is merely an epistemic rather than metaphysical one and that a deterministic agent does not have plural voluntary control. I conjecture that a dualistic account of libertarian free will may dodge the problems I raise regarding Kane’s SFAs. (shrink)

Émile Durkheim (1858-1917) gilt - neben Max Weber - als einer der beiden Gründerväter der modernen Soziologie. Er hat durch seine materialen Arbeiten nicht nur so zentrale soziologische Teildisziplinen wie die Religions-, Wissens-, Familien- und Rechtssoziologie begründet, sondern insbesondere durch sein theoretisches Werk der Soziologie als eigenständiger Wissenschaft den Weg geebnet. Hierzu trug er nicht zuletzt auch durch die Begründung einer soziologischen Zeitschrift und Formierung einer eigenen Denkschule bei. Trotz seines internationalen Renommees blieb sein Werk in der deutschen Theoriediskussion stets (...) eigentümlich vernachlässigt. Der erste Einführungsband über das Werk Durkheims in deutscher Sprache beschreibt die zeitgeschichtlichen und biografischen Hintergründe seines Lebens und erläutert die Ausgangsprobleme, die die Soziologie in den Augen ihres Begründers lösen sollte. Die Quintessenz seines soziologischen Werks wird in der Begründung einer rationalen Moral resümiert. Nach der Ausleuchtung der konkreten Gestalt, die Durkheim dem soziologischen Denken übertrug, widmet sich Daniel Šuber eingängig der wissenssoziologischen Relevanz des Durkheim'schen Werks. Gilt er gemeinhin nicht als deren Begründer, wird hier gezeigt, wie tief sein Denkansatz von der wissenssoziologischen Grundidee der ”Seinsbedingtheit allen Denkens“ (Mannheim) von Beginn an geprägt war. Heroin use poses a significant health and economic burden to society, and individuals with heroin dependence are responsible for a significant amount of crime. Owing to its efficacy and cost-effectiveness, methadone maintenance therapy (MMT) is offered as an optional alternative to imprisonment for drug offenders in several jurisdictions. Some object to such 'MMT offers' on the basis that they involve coercion and thus invalidate the offender's consent to MMT. While we find these arguments unpersuasive, we do not attempt to build (...) a case against them here. Instead, we explore whether administration of MMT following acceptance of an MMT offer might be permissible even on the assumption that MMT offers are coercive, and in such a way that the resulting MMT is non-consensual. We argue that non-consensual MMT following an MMT offer is typically permissible. We first offer empirical evidence to demonstrate the substantial benefits to the offender and society of implementing non-consensual MMT in the criminal justice system. We then explore and respond to potential objections to such uses of MMT. These appeal respectively to harm, autonomy, bodily and mental interference, and penal theoretic considerations. Finally, we introduce and dismiss a potential response to our argument that takes a revisionist position, rejecting prevailing incarceration practices. (shrink)

Investigating the concepts and material realities of energy coursing through the arts: a foundational text. This book investigates energies—in the plural, the energies embedded and embodied in everything under the sun— as they are expressed in the arts. With contributions from scholars and critics from the visual arts, art history, anthropology, music, literature, and the history of science, it offers the first multidisciplinary investigation of the concepts and material realities of energy coursing through the arts. Just as Douglas Kahn's (...) earlier books helped introduce sound as a category for study in the arts, this new volume will be a foundational volume for future explorers in a largely uncharted domain. Vedānta, owing to its straightforward dialogical style and lucid presentation of bedrock theories of the school. It has been ascribed, along with literally hundreds of other works, to the preeminent philosophical commentator in Advaita's illustrious history, Śaṅkara (ca. 650-700 C.E.). Modern lndological scholarship, however, has contested both of these grounds for its fame, calling into question its consistency with the theoretical framework laid down by Śaṅkara as well as its traditional attribution to the hand of the medieval Kerela master.In The Vivekacūḍāmaṇi of Śahkarācārya Bhagavatpāda: An Introduction and Translation, his recent translation of The Crown Jewel—the tenth made into English—John Grimes sets out to defend the integrity of tradition against modern criticism. Grimes, whose incisive scholarship has given us a number of important works on Advaita such as An Advaita Vedanta Perspective on Language and Problems and Perspectives in Religious Discourse: Advaita Vedanta Implications, as well as A Concise Dictionary of Indian Philosophy, applies his considerable Sanskrit and Advaita acumen to The Crown Jewel in order to achieve a twofold goal. In the Preface he vows to contribute a readable translation that is attentive to the religious sensibilities and goals of the Vivekac&umacrḍāmaṇi to guide the reader to ultimate wisdom and liberation but also to offer a rendition that speaks to contemporary audiences in an inclusive way, opening the possibility of knowledge of purified Selfhood to male and female readers alike (pp. vii-ix). At the same time, given the length to which he goes concerning this matter in his extensive Introduction, Grimes proves himself keen to show that, despite modern objections and reservations, "a strong case can be made that the Vivekacūḍāmaṇi is a genuine work of Śaṅkara's and that it differs in certain respects from his other works in that it addresses itself to a different audience and has a different emphasis and purpose" (p. 13). What is offered to the modern reader in this translation, then, is a defense of the traditional authorial and authoritative status of this popular Advaita treatise.Grimes' presentation falls into two parts. The first is a fifty-page Introduction that includes the life and teachings of Śaṅkara, a rundown on the basic doctrines of Advaita Vedānta, and reflections on the various approaches to the study of author and school. Much of this Introduction is occupied with the question of whether the historical Śaṅkara actually wrote the Vivekacūḍāmaṇi, in a discussion that engages the criteria for reliably attributing a work to him set down by Paul Hacker a half century ago. Here, Grimes immerses himself in a debate in which Hacker came down on the side of Śaṅkara having written the work, while Daniel lngalls and Sengaku Mayeda, following Hacker's own criteria, have rejected this conclusion. Grimes point by point traverses Hacker's criteria of authorship, particularly Hacker's analysis of how Śaṅkara defines basic terms such as avidyā, anirvacanīya, prāgabhāva, and other related concepts in works such his commentary on the Brahmasūtra compared to how these are defined in The Crown Jewel. In this article, I discuss the extent to which St. Paul’s view of the doctrine of Original Sin ought to be taken as authoritative for confessing Christians today. I begin with the observation that there are, in the main, two camps represented in the contemporary literature. On the one hand, there are those who affirm the presence of Original Sin in Rom. 5, and consequently embrace the doctrine; on the other hand, there are those who deny Original Sin any substantive (...) anchor in the text, and as a result conclude it is not necessary to believe today. I argue that things are not so straightforward, and present what I take to be a legitimate via media between these two positions. In the first main section of the article, I argue on exegetical grounds that Rom. 5:12–21 can be rendered adequately intelligible only when we admit that something like the Augustinian view of Original Sin is present at least in nuce. This I attempt to demonstrate in conversation with Douglas Moo and C. E. B. Cranfield. While not, of course, the full-blown Augustinian doctrine, St. Paul's mind is, I contend, much nearer to the former’s view of Original Sin than is commonly supposed. However, in the second main section I turn my attention to the question, So what? I discuss a number of theological and exegetical considerations which make it clear, I think, that St. Paul is not urging belief in Original Sin so much as he is utilizing an “intertestamental expansion” of an OT text to paint a picture about Christ and what we ought to believe about him. As such, I encourage and defend the application of a relatively mild hermeneutical principle which will allow the theologian a clear and biblically faithful way around the doctrine of Original Sin, if this is what is desired. Conservatism is part of the legacy of the pragmatic tradition’s deep respect for the continuity of inquiry. Despite his commitment to open and fallible inquiry, Charles Sanders Peirce remained his entire life a kind of religious conservative, arguing for a community that would be, in Douglas Anderson’s words “conservative in its practice and liberal in its theory.”1 The following argument is largely about Peirce’s career-long struggle to reconcile conservative practice and liberal theory, especially as they impact his philosophy of (...) inquiry. John Harris's influential work on human enhancement has advocated the development, use, and exchange of human enhancement technologies. The types of enhancements that are of interest are biomedical interventions that are used to improve human capacities beyond what is necessary to achieve or maintain health or "normal functioning". This new book is unique in Harris's body of work in that it takes a more cautious stance regarding moral enhancements than he has taken toward other forms of human enhancement, such as (...) cognitive enhancements. I examine and evaluate Harris's main arguments for this cautious stance. Two of the main issues that are discussed are: (1) whether it would be unethical for someone to use biomedical technologies to become less racist and (2) whether it would be unethical for someone to use biomedical technologies to reduce impulsive violent aggression. In 1979, Douglas Hofstadter published Gödel Escher Bach: An Eternal Golden Braid , a brilliant exploration of some of the most difficult and fascinating ideas at the heart of cognitive science: recursion, computation, reduction, holism, meaning, "jootsing" (jumping out of the system), "strange loops", and much, much more. What made the book's expositions so effective were a family of elaborate (and lovingly elaborated) analogies: the mind is like an anthill, a formal system is like a game, theorem and nontheorem (...) are like figure and ground, Bach's Inventions are like dialogues, and much, much more. The whole analogy-package was wrapped in layers of self-conscious reflection. "Anything you can do I can do meta-" was one of Doug's mottos, and of course he applied it, recursively, to everything he did. (shrink)

The best interest standard is the threshold most frequently employed by physicians and ethics consultants in challenging a parent’s refusal to provide consent for a child’s medical care. In this article, I will argue that the best interest standard has evolved to serve two different functions, and that these functions differ sufficiently that they require separate standards. While the best interest standard is appropriate for choosing among alternative treatment options for children, making recommendations to parents, and making decisions on behalf (...) of a child when the legal decision makers are either unable to make a decision or are in dispute, a different standard is required for deciding when to seek state interference with parental decision-making authority. I will suggest that the harm principle provides a more appropriate threshold for determining when to seek state intervention than the best interest standard. (shrink)

Thousands of U.S. parents choose to refuse or delay the administration of selected vaccines to their children each year, and some choose not to vaccinate their children at all. While most physicians continue to provide care to these families over time, using each visit as an opportunity to educate and encourage vaccination, an increasing number of physicians are choosing to dismiss these families from their practice unless they agree to vaccinate their children. This paper will examine this emerging trend along (...) with the reasons given by those who advocate such an approach. I will argue that the strategy of refusing to allow families into a clinic unless they agree to vaccinate their children is misguided, and the arguments for doing so fail to stand up to close scrutiny. Such a strategy does not benefit the child or the health of the community, and may have a negative impact on both. Furthermore, some of the arguments in support of dismissal policies ignore the importance of professional obligation and appear to favor self-interest over the interest of the patient. (shrink)

Tibetan Buddhist Philosophy of Mind and Nature is a philosophical overview of Tibetan Buddhist thought. Charting the different ways Buddhist traditions in Tibet configure the relationship between Madhyamaka and Mind-Only, Duckworth shows how these configurations inform the shape of distinct contemplative practices.

The main result of this paper is a weak constructive version of the uniform continuity theorem for pointwise continuous, real-valued functions on a convex subset of a normed linear space. Recursive examples are given to show that the hypotheses of this theorem are necessary. The case of Ashley X involved a young girl with profound and permanent developmental disability who underwent growth attenuation using high-dose estrogen, a hysterectomy, and surgical removal of her breast buds. Many individuals and groups have been critical of the decisions made by Ashley's parents, physicians, and the hospital ethics committee that supported the decision. While some of the opposition has been grounded in distorted facts and misunderstandings, others have raised important concerns. The purpose of this paper is to provide (...) a brief review of the case and the issues it raised, then address 25 distinct substantive arguments that have been proposed as reasons that Ashley's treatment might be unethical. We conclude that while some important concerns have been raised, the weight of these concerns is not sufficient to consider the interventions used in Ashley's case to be contrary to her best interests, nor are they sufficient to preclude similar use of these interventions in the future for carefully selected patients who might also benefit from them. Clinical ethics training programs are responsible for preparing their trainees to be competent ethics consultants worthy of the trust of patients, families, surrogates, and healthcare professionals. While the American Society for Bioethics and Humanities (ASBH) offers a certification examination for healthcare ethics consultants, no tools exist for the formal evaluation of ethics trainees to assess their progress toward competency. Medical specialties accredited by the Accreditation Council for Graduate Medical Education (ACGME) use milestones to report trainees’ progress along a continuum of (...) professional development as a means of “operationalizing and implementing” medical competencies. Utilizing the Core Competencies for Healthcare Ethics Consultation and the ACGME and American Board of Pediatrics’ (ABP) Pediatric Milestones Project, we developed milestones for 17 subcompetencies in clinical ethics consultation and academic bioethics. As the field of clinical ethics becomes more standardized, such tools will be needed to promote the development of robust training programs and to certify that their graduates are competent practitioners. It is argued that Hellman's arguments purporting to demonstrate that constructive mathematics cannot cope with unbounded operators on a Hilbert space are seriously flawed, and that there is no evidence that his thesis is correct.

In the informal setting of Bishop-style constructive reverse mathematics we discuss the connection between the antithesis of Specker’s theorem, Ishihara’s principle BD-N, and various types of equicontinuity. In particular, we prove that the implication from pointwise equicontinuity to uniform sequential equicontinuity is equivalent to the antithesis of Specker’s theorem; and that, for a family of functions on a separable metric space, the implication from uniform sequential equicontinuity to uniform equicontinuity is equivalent to BD-N.
